1. Scope of application
The general terms and conditions of sale described below apply to all products and services sold exclusively via the e-commerce site of thools.ch. They define the rights and obligations of the parties.
Thools reserves the right to modify the content and form of these general terms and conditions of sale at any time.
2. Offer
The offer is addressed to individuals or legal entities residing or having their headquarters in Switzerland. Products are only delivered to addresses located in Switzerland.
The offer is valid as long as it is visible in the online store, within the limits of available stock. Price and assortment changes may be made at any time.
3. Products
The products visible on the site thools.ch as well as real-time information on their availability are provided for informational purposes and do not constitute offers from Thools.
Thools reserves the right to restrict the quantities delivered for certain products and not to carry out delivery in the case of particularly heavy or bulky orders.
4. Personal data
Thools is committed to respecting the confidentiality of personal data provided by customers on the site thools.ch and to process them in accordance with legal obligations.
Personal data will only be transmitted to third parties to the extent that it is essential for the execution of the order. No data will be transmitted to third parties for commercial purposes.
Customer data may be used by Thools' internal services:
- For processing orders, deliveries, and billings
- To gather their opinion in order to improve products and services
The customer agrees to provide the personal information necessary for managing their order (delivery and billing). This information must be correct, valid, and up to date. Identification and password information must remain confidential for the customer.
5. Sales process
5.1. Orders
Once the desired product is selected, it can be added to the shopping cart by clicking on "add to cart". The customer can then continue to select other items, modify the shopping cart, or proceed to the next step to finalize the order and proceed to payment.
The validation of the order by the customer constitutes acceptance of the general terms and conditions of sale.
An order is considered a request to conclude a contract with thools.ch.
Once the order is validated and paid, the customer receives an order confirmation by email.
5.2. Price
The prices indicated for each item on the site thools.ch include all taxes and do not include preparation or delivery fees. Shipping costs will be indicated before the final validation of the order.
Thools reserves the right to modify the prices and other fees displayed on the site thools.ch without notice. However, the products will be billed to the customer according to the rates in effect at the time of order validation.
5.3. Product Representation
Thools strives to provide a photographic representation as faithful as possible of the products and services offered for sale on the site thools.ch. However, due to presentation limitations on the Internet, it is possible that the customer's perception of the photographic representation does not exactly match the products themselves.
5.4. Secure Payments
The accepted payment methods are:
- Visa, Mastercard, Paypal, TWINT
Payments are made on the secure servers of Thools' partners, as mentioned above. No banking or postal information regarding the customer is transmitted via the site thools.ch. Payment by credit or postal card is therefore perfectly secure.
The order is recorded and validated once the payment is accepted by the payment system chosen by the customer. Their card is automatically charged upon order registration.
The customer must fill out the registration form provided on thools.ch before being able to validate an order. The details of the credit card or Postcard are encrypted using the SSL (Secure Socket Layer) protocol and are never transmitted in clear text over the network. Payment is made directly to the payment service providers. The card number is not transmitted to Thools.
The order is considered effective after confirmation of the agreement from the banking payment centers.
5.5. Delivery
Shipping costs are calculated based on weight, volume, and the rates of the carrier responsible for delivery. They are the responsibility of the customer if the total amount of the ordered products is less than CHF 50.-, and amount to CHF 7.50.-.
Thools ensures the shipping of goods sold via the site thools.ch. Products are sent to the delivery address provided by the customer during the ordering process.
From the order and payment confirmation, the approximate delivery times are as follows:
- 2 to 4 working days for Switzerland
In case of temporary stock shortages, Thools commits to delivering the missing item as quickly as possible or to offering a replacement solution.
5.6. Returns, withdrawal, and refund
From the receipt of the product by the client, they have a withdrawal period of 14 days to return the product, with return costs being at their expense. Only products purchased through the site thools.ch and returned in their original packaging in perfect condition may be eligible for a refund.
The procedure to follow is as follows:
- The client sends an email to hello@thools.ch to request a return
- The client returns the goods at their own expense to the address indicated by Thools
The product must be accompanied by:
- The order number
- The name of the person making the return
The product is checked by Thools' internal services, which validate or not the refund by verifying that the product has been returned complete and in a condition allowing its resale, in accordance with the right of withdrawal.
If the goods meet the return conditions, they may be eligible for a refund or exchange.
If the goods do not meet the return conditions, they will be sent back to the client who will not be able to obtain a refund.
6. Applicable law
Swiss law applies to the legal relationship between thools.ch and the client, excluding provisions related to legal conflicts and the Vienna Convention. The competent court for individuals is Vevey or the client's place of residence.
